Details Surface On Former Korn Drummer’s Lawsuit

Thanks to this site, we now know even more about the lawsuit that’s been filed against Korn by the band’s original drummer David Silveria.

Filed by Silveria’s attorney James Bryant, the suit seeks a forensic accounting of the band’s revenues from 2006 and damages for breaching a partnership agreement initiated after Korn tracked its first album.

He wants that partnership dissolved after the rest of the band cuts him a fat check.

Silveria’s suit claims that under the band’s partnership, Korn’s members were to share equally in all earnings and losses.

His suit says when he jumped ship in 2006, it was only for a little while, and that it was understood he would be returning to the band at some point.

“Despite Silveria’s temporary hiatus as Korn’s drummer, Silveria always intended on returning to the band, and under no circumstances did Silveria ever relinquish or abandon his ownership interest in the Korn Partnership, which entitled him to his percentage interest in profits derived from partnership assets.”

Silveria also alleges that guitarist Brian “Head” Welch retained a similar partnership interest, despite his absence from the band between 2005 and 2013. But when he tried to return in 2013, “primed and ready to make music once again, Silveria personally reached out to [Korn] via video message, expressing his desire to return to the band in order to reunite all founding members of Korn, and to set aside any old grudges that may have existed in the past.”

Through their manager, a good dude (as far as I can tell) named Peter Katsis, the band refused Silveria’s bid to return.

“Silveria was extremely disappointed that his business partners and former bandmates would refuse to allow him to return to a band that he helped build, even though a few months prior the band allowed Welch to return. Silveria’s disappointment was exacerbated by the fact that despite personally reaching out to each of his former bandmates, he received the news of the band’s decision through Katsis.”
